Successful applicants will have three years to apply for a green card and receive a temporary work permit, protecting them from deportation during this period. Senior administration officials estimate that about 50,000 illegal immigrant children with parents married to U.S. citizens could also qualify.
Notably, there is no requirement for how long the couple must have been married, and immigrants who reach the ten-year residency mark after the announcement date will not qualify. The administration plans to open the application process by the end of the summer, with fees yet to be determined.

Biden is expected to discuss his plans at a White House event marking the 12th anniversary of the DACA program. Democrats aim to contrast Biden’s policies with those of presumptive GOP presidential nominee Donald Trump, who has pledged to deport millions if reelected. Trump’s campaign has accused Biden of creating “another invitation for illegal immigration” with this new amnesty policy.
“Biden only cares about one thing—power—and that’s why he is giving mass amnesty and citizenship to hundreds of thousands of illegals who he knows will ultimately vote for him and the Open Border Democrat Party,” said Trump campaign spokeswoman Karoline Leavitt. This new policy is expected to prompt a rush by leftist organizations to get as many illegal immigrants as possible to apply for the program before a potential Trump administration can dissolve it.
Meanwhile, Biden plans to introduce new regulations allowing certain illegal immigrants to qualify more easily for work visas, offering stronger protections than the temporary work permits granted by DACA. This policy would build on authority used by previous presidents to allow “parole in place” for family members of military members, enabling qualifying illegals to pursue U.S. permanent residency without leaving the country.
